Below is a brief overview of the basics: One important purpose of probate is to transfer property which is titled only in the name of a deceased person. It is the jurisdiction of the Probate Court to give someone the authority to distribute this property as per the wishes expressed in the decedent’s Last Will and Testament or as per the Missouri Statutes. Table of Consanguinity Examples of Decedent Estates are: Letters Testamentary / Letters of Administration Affidavit to Establish Title Petition to Determine Heirship Refusal of Letters – Spouse / Minor / Creditor The Probate Court also has jurisdiction to appoint someone as the guardian of an incapacitated person or as the conservator of the assets of a disabled person. In some instances, it may be necessary to appoint a guardian and/or conservator of a minor child. Other examples of probate cases include: Resolution of trust issue 96 hour commitments Sexually violent predators Probate records are public record, unless otherwise determined by the courts to be confidential.
