Probate is often a confusing area of the Court system. Below is a brief overview of the basics:

One important purpose of probate is to transfer property which is titled only in the name of a deceased person. It is the jurisdiction of the Probate Court to give someone the authority to distribute this property as per the wishes expressed in the decedent’s Last Will and Testament or as per the Missouri Statutes.

Refusal of Letters – Spouse / Minor / Creditor

The Probate Court also has jurisdiction to appoint someone as the guardian of an incapacitated person or as the conservator of the assets of a disabled person. In some instances, it may be necessary to appoint a guardian and/or conservator of a minor child.

Probate records are public record, unless otherwise determined by the courts to be confidential. Confidential records include Mental Health and Alcohol & Drug related cases.
